Complete customs clearance of cargos in the Republic of Kazakhstan

Green light customs passage – purposed for goods declaration in regard to which there were no recommendations and random selection method was not applied. No customs control forms were not applied therefor. The customs control is performed after issue during the period of limitation of legal action.

Red light customs passage – purposed for goods declaration subject to customs control: customs inspection, examination and customs expertise.

Yellow light customs passage – purposed for goods declaration subject to documentary control prior to issue in accordance with article 410 of the Code of Customs Regulation of the Republic of Kazakhstan provided for by issue with CDT (Customs Duties and Taxes) payment. The half of goods declarations sent to yellow light customs passage is related to customs undervaluation risk

Blue light – purposed for goods declaration in regard to which, within framework of inspection of customs and other documents, performed prior to issue, the decision was made to perform documentary control for compliance with measures of tariff and non-tariff regulation provided for by issue without CDT (Customs Duties and Taxes) payment.

In presence of signs of inconsistent determination of goods customs value:
a) information incompliance with customs value in different shipping documents
b) lower price of imported goods compared to identical or homogeneous goods under commensurable conditions of their import;
c) lower price of imported goods compared to information of market quotations, market indexes, auction prices, information from price catalogue;
d) lower price of imported goods compared to components price (including raw materials), which contain (consist of) imported goods;
e) interrelation of seller and buyer of imported goods combined with lower price at the market;
f) evidence suggesting that structure of imported goods customs value is not compliant (e.g., license and other similar payment for usage of intellectual property objects, transportation charges of imported goods, insurance expenses etc.)

It is possible and it should be proved. Because when agreeing with additional charge, Risk management system inputs your corrected value into data base. Thus, the risk of repeated customs value inspection occurs

a. Foreign economic contract of established form (payment due date, warranty liabilities): supply agreement, purchase-sale agreement, etc.
b. Invoice translated into russian (most preferable)/ packing list (with information on type of duties (charges))!
c. Documents and data on transportation, if not included into price: CMR*Agreement on International Goods Transport by Rail, shipping invoice, Carnet TIR/T1.
d. Customs declaration of country of dispatch (EX1, ABD)
e. Application/payment orders for money transfer in favor of a seller
f. Accounting of goods receipt.

COCF – the Center of Online Customs Filling is the new subdivision in the national revenue authorities. One of the main goals for establishing COCF was to minimize cooperation of customs authority and customs declarant during the process of customs operations. Cooperation with territorial authorities shall be performed using Telegram-channels. The Purpose – centralization of goods customs value control at the level of National Revenue Committee.
